Acceptance of Terms

These Terms & Conditions (the “Terms”) are an agreement between you and AZ Water Damage Restoration (“we,” “us,” “our,” or the “Company”). They govern your use of azwaterdamagerestoration.com (the “Website”) and the restoration, mitigation, and related services we provide (the “Services”).

By browsing the Website, submitting a contact or inspection form, calling or texting our dispatch line, or accepting Services from us, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, please do not use the Website or request Services.

Eligibility

You must be at least 18 years old and legally able to enter into a contract to request Services. If you request Services on behalf of a household, business, property-management company, or landlord, you represent that you are authorized to do so and to permit work on the property.

Separate work authorizations

For most jobs we also ask you to sign a written Work Authorization, scope of work, or service agreement on site. Those documents describe the specific work for your property. Where a signed document conflicts with these Terms, the signed document controls for that project; these Terms continue to govern everything else, including your use of the Website.

About Our Company

AZ Water Damage Restoration is an Arizona property restoration contractor based in Phoenix, operating under ROC License #331127. Our technicians hold IICRC certifications and follow recognized industry standards for water damage restoration and mold remediation.

We serve Phoenix and the surrounding metro area, including Scottsdale, Mesa, Tempe, Chandler, Gilbert, Glendale, Peoria, Surprise, Avondale, Goodyear, Buckeye, and nearby communities. Coverage outside these areas is offered case by case. See areas we serve for current coverage.

24/7 emergency response

Our dispatch line is staffed around the clock, every day of the year, and we target rapid arrival for active-loss emergencies in our core metro coverage area. Response targets are goals, not guarantees — see Section 5.

Website Use

Permitted use

You may use the Website to learn about our Services, read our educational content, request an inspection or estimate, and contact us. You may view, download, and print pages for your own personal or internal business use in connection with a potential or active project.

Prohibited activities

You agree not to:

  • Use the Website for any unlawful, fraudulent, or deceptive purpose
  • Submit false, misleading, or impersonated contact or loss information
  • Scrape, harvest, spider, or bulk-copy content, images, or contact data
  • Republish, resell, or repurpose our written content, photography, or branding
  • Attempt to probe, breach, overload, or interfere with the Website or its infrastructure
  • Upload malware, spam, or automated form submissions
  • Reverse-engineer or interfere with any part of the Website’s code or security

Accuracy of information

We work to keep the Website accurate and current. Even so, content is general information about restoration work — it is not a professional inspection, a diagnosis of your property, or legal advice. Pricing ranges, timelines, drying durations, and process descriptions are illustrative and will differ from your project. Nothing on the Website is an offer or a binding quote.

Your responsibilities

  • Provide accurate contact details, property address, and a truthful description of the loss
  • Keep your login-free submissions free of sensitive data you do not want transmitted by email
  • Use your own judgment about safety before entering a damaged structure

Emergency Services Disclaimer

Website forms are not an emergency dispatch system. Contact forms, inspection requests, email, and chat submissions are routed to our team during normal handling and are not monitored as an instantaneous 24/7 alert channel. A submitted form does not create a dispatch, reserve a crew, or establish a response time.

Calling is the fastest way to reach us. For an active leak, flood, sewage backup, or storm intrusion, call (602) 755-0251. A live person answers our dispatch line 24 hours a day. Texting photos is a good follow-up, but the call is what starts dispatch.

Before we arrive, stop the water at the source if it is safe to do so, and shut off electricity to affected areas only if you can reach the panel safely. We are not responsible for damage that continues while you wait for a form response instead of calling.

Service Availability

Our dispatch line operates 24/7, but the ability to send a crew depends on technician availability, equipment inventory, and job volume at the time you call.

Arrival times are estimates

Any arrival window we quote — by phone, text, or on this Website — is a good-faith estimate, not a contractual commitment. We will tell you promptly if our estimated arrival changes materially.

Conditions that affect response

  • Monsoon storms, flash flooding, extreme heat, and other severe weather
  • Regional catastrophe events that spike demand across the metro simultaneously
  • Traffic, road closures, and freeway incidents
  • Property access issues — locked gates, unavailable keys, HOA or building restrictions
  • Unsafe site conditions requiring a utility company, plumber, or first responder first
  • Equipment or specialty-crew availability for large or contaminated losses

We may decline or discontinue work at any property where conditions are unsafe, access is denied, the scope exceeds our capabilities, or payment arrangements cannot be established.

Section 06

Estimates & Pricing

Inspections

We offer a no-cost visual damage inspection for most residential and commercial properties in our core service area. Certain assessments — third-party laboratory mold testing, engineering reports, or inspections requested purely for litigation or real-estate purposes — may carry a fee, which we will disclose before we begin.

Estimates are non-binding

Unless we expressly identify a document as a “fixed-price” or “not-to-exceed” proposal and both parties sign it, every estimate is a preliminary projection based on what was visible and measurable at the time. It is not a final price.

Change in scope

Restoration work regularly uncovers conditions that were hidden behind finishes: saturated insulation, wet subfloor, concealed microbial growth, failed plumbing, asbestos-containing or lead-based materials, or structural rot. When that happens, we will document the finding and discuss a revised scope and price with you before performing the additional work, except where immediate action is required to prevent imminent further damage or a safety hazard.

Final invoices

Final invoicing reflects actual work performed: labor hours, equipment days, materials, disposal, and any approved change orders. Drying equipment is typically billed per unit, per day, and the number of days is determined by moisture readings rather than a fixed schedule. Your final invoice may therefore be higher or lower than the initial estimate. See our cost guide for how pricing typically works.

Customer Responsibilities

Restoration is a partnership. To keep your project on schedule and on budget, you agree to:

Information

  • Give accurate details about the source, timing, and history of the damage
  • Disclose known hazards — asbestos, lead paint, prior mold, pest issues, structural problems
  • Share accurate ownership and billing information
  • Notify us promptly if you discover new damage or a recurring leak

Access and site conditions

  • Provide safe, lawful, and timely access to affected areas for crews and equipment
  • Arrange gate codes, keys, elevator reservations, parking, or HOA approvals when needed
  • Secure pets away from work areas
  • Tell us about occupants with respiratory conditions, allergies, or mobility needs

Utilities

  • Maintain electrical service for drying equipment, or approve a generator at additional cost
  • Keep the structure closed and HVAC operating as directed during the drying period
  • Do not unplug, move, or turn off air movers, dehumidifiers, or air scrubbers without telling us — doing so can extend drying, increase cost, and void workmanship coverage

Contents and valuables

  • Remove or point out cash, jewelry, firearms, prescription medication, irreplaceable documents, heirlooms, and fragile electronics where practical before work begins
  • Tell us in advance about high-value flooring, artwork, antiques, or specialty finishes

Cooperation

  • Respond promptly to scope, material-selection, and change-order decisions
  • Attend or authorize inspection visits
  • Raise concerns with us directly and promptly so we can correct them

Restoration Process

Where applicable, our work follows recognized industry practice — including ANSI/IICRC S500 for water damage restoration and ANSI/IICRC S520 for mold remediation — together with Arizona building code and manufacturer instructions. Certifications and standards describe methods; they are not a guarantee of any particular outcome.

Typical sequence

  • Emergency response, safety assessment, and source containment
  • Inspection, moisture mapping, and category/class determination
  • Water extraction and controlled demolition of unsalvageable materials
  • Containment, negative air, and antimicrobial application where indicated
  • Structural drying with monitored equipment and daily readings
  • Verification of drying goals, then repair and reconstruction if contracted

Scope may change

Water travels. Materials hide damage. The scope documented on day one is our best professional judgment from what could be observed and measured at that moment, and it may expand as drying progresses or as materials are opened up. Some materials — certain carpets, pads, particleboard, saturated insulation, contaminated porous contents — cannot be dried in place and must be removed under industry standards even if they appear salvageable.

Demolition and disposal

Restoration frequently requires cutting drywall, removing baseboard and flooring, and disposing of affected materials. By authorizing work, you authorize the necessary removal and lawful disposal of those materials. Exact color, texture, grain, or pattern matching of existing finishes is not always achievable, and we do not warrant a perfect match to aged or discontinued materials.

Scheduling & Cancellations

Scheduling

Non-emergency inspections, monitoring visits, and reconstruction work are scheduled by appointment window. Emergency dispatch is handled by priority and availability rather than by appointment.

Rescheduling and missed appointments

Please give us at least 24 hours’ notice to reschedule a non-emergency appointment. If our crew arrives and cannot access the property, we may charge a trip fee for the mobilization. We may also reschedule when weather, an emergency call, or a safety issue requires it, and we will notify you as soon as we can.

Emergency dispatch

Emergency requests are triaged by severity, contamination category, and health risk. Confirming a dispatch commits crew time and equipment; if you cancel after a crew is en route or on site, we may bill for the mobilization and any work already performed.

Cancellation of a project

You may cancel scheduled Services by calling (602) 755-0251 or emailing dispatch@azwaterdamagerestoration.com. Cancellation takes effect when we acknowledge it. You remain responsible for work already completed, equipment already placed, materials already ordered or fabricated, and any statutory or contractual cancellation rights described in your signed Work Authorization. Where Arizona or federal law grants you a right to cancel within a stated period, nothing in these Terms limits that right.

Section 10

Payments

Accepted payment methods

We accept major credit and debit cards, ACH and bank transfer, business and personal checks, and cash. Financing may be available for qualifying projects.

When payment is due

  • Invoices are due on receipt unless a different term appears on the invoice
  • Reconstruction projects may be billed in progress draws tied to milestones

Late payments

Past-due balances may accrue a service charge at the maximum rate permitted by Arizona law. We may suspend work, remove equipment, or withhold warranty coverage on unpaid work while a balance is outstanding.

Collections and lien rights

If a balance remains unpaid, we may refer the account to collections or pursue legal remedies, and you may be responsible for reasonable collection costs, court costs, and attorneys’ fees to the extent Arizona law allows. As a licensed Arizona contractor we also reserve all mechanic’s and materialman’s lien rights under Arizona Revised Statutes Title 33.

Disputed charges

If you believe an invoice is incorrect, tell us in writing within 15 days of the invoice date and identify the specific line items. We will review the documentation with you and correct any error we find. Undisputed portions remain due while a dispute is reviewed.

Section 11

Warranty Disclaimer

Workmanship

We warrant our labor and workmanship for the period stated in your signed Work Authorization or contract. Where no period is stated, we warrant workmanship on reconstruction work for one (1) year from substantial completion. Mitigation and drying services are warranted to have been performed in accordance with applicable industry standards at the time of service.

Manufacturer warranties

Materials, fixtures, appliances, flooring, and equipment carry only the manufacturer’s warranty. We pass those warranties through to you where they are transferable, and we do not extend, enlarge, or substitute our own warranty for them.

Limitations

  • Warranty coverage requires payment in full for the work at issue
  • Coverage runs to the original customer at the original property and is not transferable unless we agree in writing
  • You must notify us of a warranty concern promptly after discovering it, and allow us reasonable access to inspect and correct it
  • Our remedy is repair or re-performance of the defective work, at our option

Exclusions

  • Damage from a new or recurring water source, plumbing failure, or roof leak
  • Work performed, altered, or repaired by you or another contractor
  • Normal wear, settling, hairline cracking, fading, and expansion or contraction of materials
  • Pre-existing conditions, prior repairs, and defects in the original construction
  • Failure to maintain the property, run HVAC, or address humidity and drainage issues
  • Acts of nature, monsoon events, flooding, fire, pests, and vandalism
  • Cosmetic variation in color, texture, or finish match with existing materials
Section 12

Limitation of Liability

To the fullest extent permitted by Arizona law, our total liability arising out of the Website or the Services is limited to the amount you actually paid us for the specific Services giving rise to the dispute.

We are not liable for

  • Indirect and consequential damages — lost profits, lost rent, business interruption, loss of use, relocation or hotel costs, diminished property value, or emotional distress
  • Delays outside our control — permits and inspections, supply-chain and material availability, utility outages, or other trades
  • Pre-existing conditions — prior damage, prior repairs, code deficiencies, deferred maintenance, deteriorated plumbing, or defective original construction
  • Hidden or concealed damage — conditions inside wall cavities, under slabs, beneath flooring, or within structural assemblies that could not reasonably be detected during a non-destructive inspection
  • Mold growth from delayed reporting — microbial amplification can begin within 24 to 48 hours of a water intrusion; we are not responsible for growth that develops before we are called, while you decide whether to proceed, or where you decline recommended scope
  • Force majeure — flood, fire, monsoon, storm, earthquake, pandemic, labor action, civil unrest, government order, utility failure, or any other event beyond our reasonable control
  • Movement of contents — pre-existing damage to items we move, and items you did not identify as high value or fragile

Indemnification

You agree to indemnify and hold us harmless from claims arising out of inaccurate information you provided, undisclosed hazards at the property, your failure to authorize recommended work, or your breach of these Terms.

Section 13

Third-Party Services

Some projects need specialists we do not perform in-house. We may recommend, coordinate with, or subcontract to third parties such as:

  • Licensed plumbers and leak-detection companies
  • Electricians and HVAC contractors
  • Roofing contractors and window or door installers
  • Independent indoor air quality and mold testing laboratories
  • Asbestos and lead abatement contractors
  • Structural engineers, pack-out and storage providers, and specialty cleaners

Where a third party contracts directly with you, their agreement, pricing, insurance, and warranty govern that work, and we are not responsible for it. We recommend using an independent laboratory for post-remediation verification so that testing stays impartial. Where we subcontract a trade under our own contract with you, we remain responsible for that scope as stated in your Work Authorization.

Section 14

Intellectual Property

All content on the Website — the AZ Water Damage Restoration name and logo, page copy, guides and blog articles, photography and project galleries, video, illustrations, icons, layout, and the design system itself — is owned by us or used under license, and is protected by United States copyright, trademark, and trade dress law.

What you may not do

  • Copy, republish, or adapt our written content on another website or in marketing materials
  • Use our before-and-after project photography as your own work
  • Use our name, logo, or brand colors in a way that suggests affiliation or endorsement
  • Register a confusingly similar business name, domain, or social handle
  • Use our content to train commercial machine-learning models without written permission

You may link to our pages and quote a short excerpt with clear attribution and a link back. For any other use, email dispatch@azwaterdamagerestoration.com. If you believe content on the Website infringes your copyright, contact us with the details and we will investigate promptly.

Section 15

User Submissions

“Submissions” means anything you send us through the Website or otherwise: contact and inspection forms, damage photos and video, reviews and testimonials, questions, and feedback.

Your promises

  • The Submission is accurate and yours to send
  • You have the right to share any images of a property or its contents
  • It contains nothing unlawful, defamatory, infringing, or malicious

Our license to use them

You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your Submission to deliver Services and improve our work. We may publish reviews, testimonials, and project photos in our marketing — but we will not publish your street address, full name without permission, or identifiable interior contents when you ask us not to. Tell us at any time and we will remove your material from future marketing.

Reviews and testimonials

We publish genuine customer feedback. We do not pay for reviews, and we do not edit a review’s substance. We may decline to publish, or later remove, content that is off-topic, abusive, or discloses another person’s private information.

Section 16

Privacy

How we collect, use, store, and share your information is described in our Privacy Policy, which is incorporated into these Terms by reference. In short: we use your information to respond to your request, deliver Services, and — where you have opted in — send you updates. We do not sell your personal information.

Section 18

SMS, Calls & Email Communications

By giving us your phone number or email address — on a form, by text, or over the phone — you agree that we may contact you about your request and your project.

Types of messages

  • Transactional — dispatch confirmations, technician arrival notices, estimate and invoice delivery, and drying-log updates
  • Appointment reminders — inspection, monitoring, and reconstruction visits
  • Emergency communications — urgent updates about safety or conditions at your property
  • Marketing — seasonal maintenance tips and offers, sent only if you opt in separately

Consent and calling terms

Calls and texts may be placed using automated technology, and calls may be recorded or monitored for quality and training where Arizona law permits. Consent to marketing messages is never a condition of purchasing Services. Message frequency varies. Message and data rates may apply, and carriers are not liable for delayed or undelivered messages.

Section 19

Governing Law

These Terms and any dispute arising from them or from the Services are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-laws principles.

The exclusive venue for any action is the state or federal courts located in Maricopa County, Arizona, and both parties consent to personal jurisdiction there.

Resolve it with us first

Before filing anything, please contact us at (602) 755-0251 or dispatch@azwaterdamagerestoration.com and give us a fair chance to make it right — most concerns are resolved in a single conversation. Arizona homeowners may also contact the Arizona Registrar of Contractors regarding licensed contractor work. Any dispute must be brought within the time allowed by Arizona’s applicable statute of limitations.

Section 20

Changes to These Terms

We may update these Terms as our Services, technology, and legal requirements change. When we do, we will revise the “Last Updated” date at the top of this page and post the new version here.

For material changes we will make the update conspicuous on the Website — and, where a change affects an active project, we will tell you directly. Your continued use of the Website or acceptance of Services after an update means you accept the revised Terms. The version in effect when you signed a Work Authorization governs that project.

We recommend reviewing this page before starting a new project with us.
